\tBicycle Rental Agreement, Liability Waiver, and Release<\/p>\n

WOW air ehf., id. 451011-0220, Katr\u00ednart\u00fani 12, 105 Reykjav\u00edk,is the owner of aself-servebicyclerentalsystem(\u201cService<\/u>\u201d)(\u201cCompany<\/u>,\u201d\u201cOur<\/u>,\u201dor\u201cWe<\/u>\u201d).InconsiderationofyouruseofService,Companyrequiresthatyou(\u201cUser<\/u>\u201d,\u201cYou<\/u>\u201d,or\u201cYour<\/u>\u201d)agreetoalltermsandconditionsinthisBicycleRentalAgreement,LiabilityWaiver,andRelease(\u201cAgreement<\/u>\u201d),whichareintendedtopromotethesafeuseof WOW citybikebicycles,andwhichapplytoallLong-TermUsersas well astoallSingle TripUsers,asdefinedbelow. InthisAgreement,\u201cUser\u201dmeansandincludesbothLong-Term UsersandSingle Trip Users.<\/p>\n

 <\/p>\n

Section1.ModificationstoAgreement<\/u><\/strong><\/p>\n

\u00a0<\/strong><\/p>\n

Companyreservestherighttounilaterallyamend,modify,orchangethisAgreement,atanytimeandfromtime totimeinitssole discretion,without notice andwithoutUser\u2019sconsent.Bycontinuingto useanyServiceafteranyamendment,modification,orchange,Userhasagreedtobeboundbyallsuchamendments,modifications,and changes.User mustcarefullyreviewthisAgreementonaregularbasistomaintainawarenessofallamendments,modifications,andchanges.WheneverachangeismadetothisAgreement,Companywillpostanotificationonwww.wowcitybike.com(\u201cWebsite\u201d).<\/p>\n

 <\/p>\n

Section2.Term<\/u><\/strong>ofAgreement<\/u><\/strong><\/p>\n

\u00a0<\/strong><\/p>\n

This Agreementshall remain in full force and effect beginning with Yourfirstuseof anyService,andas otherwise provided in this Agreement;provided<\/u>,however<\/u>,thatYourpersonalfinancialresponsibilityunderSection15ofthisAgreement,titled\u201cCreditCardMatters\u201d,expiresoneyearafterthelaterof(i)YourlastuseofanyService,or(ii)theexpirationof any pass purchased for the use of any Service (each a \u201cPass<\/u>\u201d or \u201cUser Pass<\/u>\u201d).Atanytimeandfromtimetotime,andwithoutUser’sconsent,CompanymayunilaterallyterminateYourrighttouseanyService,inCompany\u2019ssolediscretionandwithoutanynoticeorcause.ThisAgreementremainsinfullforceandeffectafteranyterminationofYourrighttouseanyService.<\/p>\n

 <\/p>\n

Section3.ServiceSystem<\/u><\/strong><\/p>\n

\u00a0<\/strong><\/p>\n

TheServiceiscomprisedofWOW citybikebicyclestations(\u201cStations<\/u>\u201d),which sometimesincludeanautomatedpaystation(\u201cPayStation<\/u>\u201d),andseparatestandsthatallowthedockingofWOW citybikebicycles(\u201cBikeDocks<\/u>\u201d).TheStationsareforthepurposesoftherenting,docking,andlockingofWOW citybikebicycles,aswellastheidentificationofthe User.UndertheService,Bike Share bicyclesmayberented from any Station and must be returned to any Station.<\/p>\n

 <\/p>\n

Section4.User Passes<\/u><\/strong><\/p>\n

\u00a0<\/strong><\/p>\n

Section 4.1<\/strong>\u00a0 Long-Term Pass<\/u><\/strong>.Usermaypurchasealong-term User Pass for the use of the Service,whichmaybeforaperiodofeither(i) 30 days, (ii) 90 days or (iii) from the beginning of use of the Service until 15th<\/sup> of October.<\/p>\n

TopurchaseaLong-Term Pass,Usermustcomplete a registrationformandcreateanaccount(\u00abAccount<\/u>\u00ab) on theWebsitetobecomeaLong-TermUser(\u201cLong-Term User(s)<\/u>\u201d).WhenaLong-Term UsersubscribestotheService,CompanywillchargetheLong-Term User\u2019screditcardtheamountforthePass,asdescribedinSection5<\/u>.OnceLong-Term User\u2019screditcardpaymentclears,Companywillmailasystem card or key (\u201csystem key\u201d) with a welcome packettothemailingaddresslistedbyLong-Term User.Welcome packets are typically received by Long-Term User within one (1) week.\u00a0 Long-Term Users who elect the Long-Termoption will also have the option to select \u201cauto-renewal\u201d authorizing WOW citybiketo charge a subsequent monthly fee until Long-Term User contacts WOW citybiketo terminate such monthly automatic renewals of the monthly Long-Term Pass.UsermustactivatethesystemkeyontheWebsite,underthe\u201cLogin\u201dheading,beforeusingtheServiceforthefirsttime.\u00a0 ALong-Term PassbecomesvalidandactiveoncethesystemkeyisactivatedontheWebsite.<\/p>\n

All users, includingLong-Term Users, muststillpaytheratesassetforthinSection7<\/u>foralltripsinexcessof30minutes.Usermayrenew (if the \u201cauto-renewal\u201d option was not already selected)theLong-Term PassontheWebsite,underthe\u201cLogin\u201dheading.IftheLong-Term Passisnotrenewedwithinthisperiodoftime,thenUsermaybe required to(i)takecertainactionstoreactivateLong-Term User’sAccount,or(ii)createanentirelynewAccountforanewLong-Term Pass.TheLong-Term Pass,andthepersonalidentificationnumberandsystemkeyrelatedthereto,arenon-transferableandmaybeterminatedifUserbreachesthisAgreement,asdecidedbyCompanyinitssolediscretion.IfaPassisterminatedforanyreason,thennorefundshall beprovided.<\/p>\n

Section 4.2<\/u><\/strong>\u00a0\u00a0 Single-TripPass<\/u><\/strong>.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Usermay purchase a Pass for a period of 8hours (\u201cSingle-Trip pass<\/u>\u201d).TopurchaseaSingle-TripPass,Userwill be prompted for paymentat the Station;provided<\/u>;however<\/u>,thatSingle-TripUsermustin addition paytheratesassetforthinSection6<\/u> and all users, includingDaily Users, muststillpaytheratesassetforthinSection6<\/u>foralltripsinexcessof30minutes.<\/p>\n

Section<\/strong>5.<\/strong>Single-TripPass<\/u><\/strong>User <\/u><\/strong>Rates<\/u><\/strong>and<\/u><\/strong>Benefits<\/u><\/strong><\/p>\n

ADailyUsermustpayan$7flatfeeforaSingle-TripPass,plusadditionalchargespursuanttotheratessetforthinSection6<\/u>, and whenaSingle-TripUsersignsupfortheServiceat the Stationthe charge will appear on Daily User\u2019s credit card statement.<\/p>\n

 <\/p>\n

Section6.<\/strong>UsageRates<\/u><\/strong><\/p>\n

\u00a0<\/strong><\/p>\n

InadditiontotheLong-TermandSingle-TripPassratesoutlinedinSections4through5,allUsersaresubjecttousageratesassetforthinthechartbelow.SolongasUserreturnstheWOW citybikebicycletoaBikeDockwithin30minutes,nousagechargeapplies. UsermayremoveanotherWOW citybikebicyclefromaBikeDockafterreturningand docking thepreviousWOW citybikebicycle. If the bicycle is not returned within 30 minutes, Users will be charged usage rates based on the Pass Type:<\/p>\n

CompanymakeseveryefforttoprovidetheService from April 15 to October 15 butdoesnotguaranteethattheServicewillbeavailableatalltimes,asforcemajeureevents such as weather conditionsorothercircumstancesmightpreventCompanyfromprovidingtheService.AccesstotheServicealsoisconditionedontheavailabilityofWOW citybikebicyclesateachStation.CompanydoesnotrepresentorwarranttheavailabilityofanyServiceortheavailabilityofanyWOW citybikebicycleatanyStation.UsermayusetheWebsite orthe CycleFinder app, which may be downloaded from theiTunes Store or Google Play,toconsulttheinventoryof WOW citybikebicyclesavailableataStation.<\/p>\n

Section8.Directions<\/u><\/strong>forUsingService<\/u><\/strong><\/p>\n

Section8.1(a)RemovingBicycle<\/u><\/strong>by<\/u><\/strong>Long-TermUser<\/u><\/strong>.<\/strong>Long-Term Usermustinserthis\/hersystemkey or cardintothereaderslotontheBikeDockkeyboard,toremovetheWOW citybikebicyclefromtheBikeDock.Afterthesystemkeyhasbeeninsertedintothereaderslot,Long-Term Userwill have 20 secondstoremovetheWOW citybikebicyclefromtheBikeDock.ThesignallightremainsyellowduringthevalidationofLong-Term User\u2019ssystemkey,andthesignallightturnsgreenwhentheWOW citybikebicyclecanberemoved.Twosoundsignalsarealsoemitted.IftheWOW citybikebicycleisnotremovedwithin20second period,theBikeDocklocksandLong-Term Usermustrepeattheprocessdescribedabove.<\/p>\n

Section8.1(b)RemovingBicycle<\/u>bySingle-TripUser<\/u>.<\/strong>ASingle-TripUsermustinsertacreditcard or cashintothe Pay Station or, if using the Transit App, obtaina5-digitcodeaftercompleting the paymentprocess.TheDaily Usermustthentypethe5-digitcodeintotheBikeDockkeyboard,to removethe WOW citybikebicyclefromtheBikeDock.Afterthe5-digitcodehasbeenentered,theSingle-Trip Userhas 20secondstoremovetheWOW citybikebicyclefromtheBikeDock.ThesignallightremainsyellowduringthevalidationoftheDaily User\u2019s5-digitcode,andthesignallightturnsgreenwhentheWOW citybikebicyclecanberemoved.Twosoundsignalsarealsoemitted.\u00a0 Ifthe WOW citybikebicycleisnotremovedwithin 20 seconds,theBikeDocklocksand theSingle-Trip Usermustrepeattheprocessdescribedabove.EachtimeaSingle-Trip UserwouldliketoremoveanewWOW citybikebicyclefromaBikeDock,Daily UsermustinsertacreditcardintothePayStation, insert the applicable cash payment or renew using the Transit Appandobtainanew5-digitcode,toremovethenextWOW citybikebicycle.ADaily Usermayremoveupto fourWOW citybikebicyclesoneachcreditcardaccount,andSingle-Trip Userwillbechargedfortheuseof fourWOW citybikebicycles.\u00a0 Note that if a Single-TripUser rents multiple bicycles in one transaction, only one (1) 5-digit code will be issued for removal of the WOW citybikebicycles from the Bike Dock.<\/p>\n

 <\/p>\n

Section8.2ReturningBicycle<\/u>.<\/strong>ToreturntheWOW citybikebicycle,UsermustsecureitintoanavailableBikeDock.Asoundsignalisemitted,andthesignallightturnsyellow,thengreen,confirmingthattheWOW citybikebicyclehasbeenproperlysecuredtotheBikeDock.IftheWOW citybikebicycleisnotproperlysecuredintheBikeDock,thenthesignallightturnsred,andalongersignalsoundisemitted.Ifthesignallightturnsred,Usermustrepeattheoperationuntilthesignallightturnsgreen,andtheWOW citybikebicycleisproperlysecuredintheBikeDock.Ifthesignallightdoesnotturngreen,UsermustreturntheWOW citybikebicycletoanotheravailableBikeDock.IfthereisnoavailableBikeDockattheStation,thenUsersmustpushthe\u201cTimeCredit\u201dicononthePayStationscreenunderthe\u201cMoreOptions\u201dmenu.Long-Term UsersmustinserttheirkeyintothereaderslotonthePayStationandDaily UsersmustswipetheircreditcardatthePayStation,toobtainanadditional15-minutecreditinwhichtoreturntheWOW citybikebicycletoanotherStation.NofeeischargedtoUserfortheadditional15-minutecredit.UsermayimmediatelyremoveanotherWOW citybikebicyclefromaBikeDock.AnyWOW citybikebicyclethatisnotproperlysecuredremainsthesoleresponsibilityofUser,andtheusageratessetforthinSection4willbechargeduntiltheWOW citybikebicycleisproperlysecured.<\/p>\n

 <\/p>\n

Section8.3PermittedPeriod<\/u><\/strong>ofContinuousUse;LostorStolenBicycle<\/u><\/strong>.<\/strong>UseoftheServiceislimitedtoaperiodof8consecutivehours(\u201cPermittedPeriodofContinuousUse<\/u>\u201d).IfUsermaintainspossessionoftheWOW citybikebicyclebeyondthePermittedPeriodofContinuousUse,thentheWOW citybikebicycleisdeemedlostorstolen,User\u2019screditcardmaybechargedafeeof150.000 ISK,andapolicereportmaybefiledwithlocalauthorities.Companywill firstattempttocontacttheUserviatelephoneandemailpriortochargingthecreditcard, usingthecontactinformationprovidedbytheUseruponsubscribing,inanattempttolocatetheWOW citybikebicycle.ThedatageneratedbytheService\u2019scomputerisconclusiveevidenceoftheperiodofuseofaWOW citybikebicyclebyUser.Usermustreportthedisappearanceof a WOW citybikebicycletoCompanywithin24hoursfollowingthedisappearanceandmustreportthedisappearancetothelocalpolicedepartmentwithin48hours.IfUserpromptlyfilesapolicereportandforwardsthepolicereporttoCompany,thenCompanymay,initssolediscretion,choose to charge User a reduced fee based on theft or damage to the WOW citybikebicycle.AnyusethatexceedsthePermittedPeriodofContinuousUseisdeemedadisappearanceoftheWOW citybikebicycle,untiltheWOW citybikebicycleisfoundorreturnedtoaBikeDock.<\/p>\n

Section8.4<\/strong>LostorDamagedSystemKey<\/u><\/strong>. <\/strong>IfUser\u2019ssystem keyhasbeenlostordamaged,areplacementmaybepurchasedbycalling(354) 590 3085orbyemailinghelp@wowcitybike.com<\/a>andreportingthatthesystemkeyhasbeenlostordamaged.Areplacementchargeforthelostordamagedservicekeywillbecharged,andareplacementsystemkeywillbemailedtoUser\u2019smailingaddressofrecord.<\/p>\n

Section9.General<\/u><\/strong>Assumption<\/u><\/strong>ofRiskbyUser.<\/u><\/strong><\/p>\n

UseragreesthatridingaWOW citybikebicycleinvolvesmanyobviousandnot-so-obviousrisks,dangers,andhazards,whichmayresultininjuryordeathtoUserorothers,aswellasdamagetoproperty,andthatsuchrisks,dangers,andhazardscannotalwaysbepredictedoravoided.Useragreesthatsuchrisks,dangers,andhazardsareUser’ssoleresponsibility.UseragreesthatifUser\u2019suseofanyServicecausesinjuryordamagetoanotherpersonorproperty,thenUsermaybeliableforallresultinginjuries,damages,andrelatedcosts.BychoosingtorideaWOW citybikebicycle,Userassumesallresponsibilityforallrelatedrisks,dangers,andhazards,andUseragreesthatCompanyisnotresponsibleforanyinjury,damage,orcostcausedbyUserwithrespecttoanypersonorproperty,includingtheWOW citybikebicycleitself.UserissolelyandfullyresponsibleforthesafeoperationoftheWOW citybikebicycleatalltimes.UsermayneedtotakeadditionalsafetymeasuresorprecautionsnotspecificallyaddressedinthisAgreement.<\/p>\n

 <\/p>\n

Section10.ProhibitedActs.<\/u><\/strong><\/p>\n

UsermustnotrideaWOW citybikebicyclewhilecarryinganybriefcase,backpack,bag,orotheritemelse,ifitimpedesUser\u2019sabilitytooperateaWOW citybikebicyclesafely.<\/p>\n

Usermustnotuseanycellulartelephone,textmessagingdevice,portablemusicplayer,orotherdevicethatmaydistractUserfromsafelyoperatingaWOW citybikebicycle.<\/p>\n

 <\/p>\n

UsermustnotoperateaWOW citybikebicyclewhileundertheinfluenceofanyalcohol,drugs,orothersubstancethatmayimpairUser\u2019sabilitytosafelyoperateaWOW citybikebicycle.<\/p>\n

 <\/p>\n

UsermustnotcarryasecondpersononaWOW citybikebicycle.<\/p>\n

 <\/p>\n

UsermustnotdockorlockanybicycleinanyStationotherthanWOW citybikebicycles.<\/p>\n

 <\/p>\n

Usermustnotuseanylockingmechanism,otherthanthelockingmechanismprovidedbyCompanyattheBikeDock,tolockaWOW citybikebicycletoaBikeDock.No WOW citybikebicycle should be left unattended unless securely returned to and lock in a Bike Dock.<\/p>\n

 <\/p>\n

Usermustnotviolateanyapplicablefederal,provincial,orlocallaw,includingthoseforbicycleriders.<\/p>\n

 <\/p>\n

UsermustnotdismantleormodifyaWOW citybikebicycleinanyway.ThisruledoesnotapplytotheuseoftheseatheightadjustmentfeatureonWOW citybikebicycles.<\/p>\n

 <\/p>\n

UsermustnotexceedthemaximumweightlimitfortheWOW citybikebicycle 135kg (298pounds)orthecargocarrier10kg (22pounds).<\/p>\n

 <\/p>\n

UsermustnotoperateaWOW citybikebicycleinextremeweatherconditions,includingsnow,hail,andelectricalstorms,whichmakeitmoredangeroustooperateaWOW citybikebicycle.UserisadvisedtoadjustUser’sridingbehaviorandbrakingdistancetosuittheweatherconditions.<\/p>\n

 <\/p>\n

UsermustnotallowotherstouseaWOW citybikebicyclethatUserhasremovedfromaBikeDock.UserunderstandsthatwhenUserremovesfromaWOW citybikebicyclefromaBikeDock,itistobeusedonlybyUser. UsermustnottransferUser\u2019ssystemkey,5-digitcodeatthePayStationor anyotherAccountinformationtoanyotherperson.<\/p>\n

 <\/p>\n

Section11.AdditionalUserObligations.<\/u><\/strong><\/p>\n

\u00a0<\/strong><\/p>\n

UseragreesthatUserisacompetentbicycleoperator,issufficientlyfittosafelyoperateaWOW citybikebicycle,andhastaken all precautions necessary to ensure that User is capable of engaging insuchphysicalactivity.Likeanyphysicalactivity,ridingaWOW citybikebicyclemaycauseminorormajorinjuriesordiscomfortandmayworsenorcomplicateunderlyingmedicalconditionsordiseases.BychoosingtorideaWOW citybikebicycle,Userassumesallresponsibilityforallsuchinjuriesorothermedicalconditions.<\/p>\n

 <\/p>\n

Useragreesthatbicyclesaremachinesthatmaymalfunction,evenifthebicycleisproperlymaintained,andthatsuchmalfunctionmaycauseinjury.UseragreesthatbeforeusingaWOW citybikebicycle,UserwillinspecttheWOW citybikebicycle to determinethefollowing:(i)adequatetirepressure;(ii)operationofallbrakesandlights;(iii)properattachmentoftheseat,pedals,andbasket;(iv)goodconditionoftheframe;and(v)anysignofdamage,unusualorexcessivewear,orothermechanicalproblemormaintenanceneed.UseragreesnottoridetheWOW citybikebicycleifUsernoticesanymechanicalorotherproblemorsafetyissue,andUseragreestopromptlynotifyCompanyofallproblemsandissuesandtouseadifferentWOW citybikebicycle.Useragreestopressthe\u201cFaultyBike\u201dbuttonwithin1minuteofdockingaWOW citybikebicyclethatUsernoticeshasanymechanicalorotherproblemorsafetyissue.<\/p>\n

 <\/p>\n

UseragreesthatCompanydoesnotprovideormaintainriding paths or other locations for ridingWOW citybikebicycles,andthatCompanydoesnotguaranteethattherewillalwaysbeasafeplacetorideaWOW citybikebicycle. Roads,bicyclelanes,andbicycleroutesmaybecomedangerousduetoweather,traffic,orotherhazards.UsermustnotuseaWOW citybikebicycleforracing,ridingoff-road,oranyotheruse,besidessafeoperationonpublicorprivateroadsorpropertyanddesignatedbicycleroutes.<\/p>\n

 <\/p>\n

UseragreesthatCompanyisnotacommoncarrier.AlternativemeansofpublicandprivatetransportationareavailabletothegeneralpublicandtoUserindividually,includingpublicbus,taxis,andpedestrianpaths.CompanyprovidesWOW citybikebicyclesonlyasaconvenience,andsuchrentalavailabilityisintendedbyCompanytobeusedonlybythosepersonswhoareableandqualifiedtooperateaWOW citybikebicycleontheirownandwhohaveagreedtoalltermsandconditionsofthisAgreement.<\/p>\n

 <\/p>\n

UsermustreturntheWOW citybikebicycletoaStationandmustinserttheWOW citybikebicycleintoaBikeDock,within8hoursfromthetimetheWOW citybikebicyclewasoriginallyremovedfromaBikeDock.UseragreesthatiftheWOW citybikebicycleisnotreturnedtoaStationandinsertedintoaBikeDockwithin8hours,thentheWOW citybikebicycleisdeemedmissingorstolen,andUserdoesherebyauthorizeCompanytochargeUser\u2019screditcardas provided in Section 8.3<\/u>.<\/p>\n

UseragreesthatCompanymayrequireUsertoreturnaWOW citybikebicycleatanytime.<\/p>\n

 <\/p>\n

UseragreesthataccesstotheServiceisdeniedtoanypersonlessthan16yearsofage,whetherornotaccompaniedbyaparentorguardian.Minorswhoareatleast16yearsofagemayusetheService,butonlyiftheServiceissubscribedforbyorundertheresponsibilityoftheminor\u2019sparentorguardian;and,theparentorguardianisfullyliableforallinjuries,damages,andcostscausedbytheminor\u2019suseoftheService.<\/p>\n

 <\/p>\n

UsermustreportallaccidentsandinjuriesinvolvingaWOW citybikebicycletothelocalauthoritiesandtoWOW citybike’sCustomerServiceat(354) 590 3085assoonaspossible,butinnoeventlaterthan24hoursaftertheoccurrenceoftheaccidentorinjury.<\/p>\n

 <\/p>\n

UseragreesifUserisunabletoreportidentifyinginformationduetoamedicalemergency,Companymay,atitsdiscretion,providepersonalandcontactinformationtotheauthoritiesupontheirrequest.<\/p>\n

 <\/p>\n

Section13.Helmets.<\/u><\/strong><\/p>\n

Wearinganapprovedhelmet,properlysized,fitted,andfastened,whilecyclingmayprotectagainstaninjury,ormaylessentheseverityofaninjury,causedbyanimpacttothehead;however,bicyclehelmetsarenot100%effective,donotprotectagainstallheadinjuries,anddonotprotectagainstotherinjuries.Althoughsome provincialandlocallawsdonotrequirebicycleriderstowearhelmets,Companydoes not provide helmets to Users, but recommendsthatallriderswearaSnell,CPSC,ANSI,orASTMapprovedhelmetthathasbeenproperlysized,fitted,andfastened,accordingtothemanufacturer\u2019sinstructions.Companydoesnotrepresentorwarrantthequalityorsafetycharacteristicsofanyhelmet,andUseragreesthatCompanymustnotbeheldliableforanyinjurysufferedbyUserwhileusingtheService,whetherornotUseriswearingahelmetatthetimeofinjury.<\/p>\n

Section14.CreditCardMatters.<\/u><\/strong><\/p>\n

\u00a0<\/strong><\/p>\n

YoumustinputavalidcreditcardnumberandexpirationdatebeforeYouwillbeallowedtousetheService,andYoudoherebyrepresentandwarrantthatYouareauthorizedtousethecreditcard(CompanyacceptsonlyVisa and Mastercard).YoudoherebyauthorizeCompanytochargeYourcreditcardforallexpensesincurredonYourAccount,includingalladditionalfeesandrepaircharges.IfYoudisputeanychargeonYourAccount,thenyoumustcontactCompanywithin10daysofYourreceiptofYourstatementcontainingthedisputedcharge.Usershaveanon-goingdutytoupdateallchangesrelatingtotheircreditcard.IfaDaily UserremovesanotherWOW citybikebicyclefromaBikeDockwhilethepreviousholdisstillineffect,thenanadditionalholdwillnotbeplacedontheUser\u2019screditcard.IftheWOW citybikebicycleisreturnedwithinthe8 hourmaximumperiodofalloweduse,thentheholdmaybereleasedwithintendays,dependingontheUser\u2019sbank\u2019spoliciesregardingholds.AlldenialsofatransactionbyaUser\u2019sbank,allholds,andallothersimilarissuesaretheUser\u2019ssoleresponsibilityandshouldbedealtwithbetweentheUserandhisorherbank.CompanytakesreasonablestepstoensurethatalldatatransmittedbyCompanyisdonesafelyandprivately;however,despitethosesteps,CompanycannotguaranteethecompletesecurityofallcreditcardandotherdatatransmittedbyCompanyorProcessor.PleasereviewtheDISCLAIMERSandLIMITEDLIABILITYsectionssetforthbelow,whichareapplicabletoUser\u2019suseoftheService,includingthetransmissionofcreditcardandotherdata.<\/p>\n

Section15.<\/strong>Termination.<\/u><\/strong><\/p>\n

UsermayterminateUser’suseoftheServiceatanytime,andUsermaycancelUser’sPassatanytime;provided<\/u>,however<\/u>,that(i)norefundwillbeprovidedbyCompany,(ii)thetermofthisAgreementcontinuesinaccordancewithSection2ofthisAgreement, theholdmayremainonUser\u2019screditcardaccountforupto10days,evenifUserterminatesUser’suseoftheService,and(iii)UsermaystillbechargedanyapplicableadditionalfeesinaccordancewithSection12ofthisAgreement.<\/p>\n

Section16.Choice<\/u><\/strong>ofLaw;DisputeResolution<\/u><\/strong><\/p>\n

ThisAgreementisgovernedby,andmustbeconstruedandenforcedinaccordancewith,thelawsofIceland.The Courts of Iceland shall have exclusive jurisdiction over any dispute or claim arising out of or in connection withthis Agreement.<\/p>\n
